Information about the site publisher, its host and the conditions for using the content.

1. Site publisher

Hereinafter “ Fundy ”, “we” or “the Company”.

Anonymity of members. New Mexico law does not require the identity of the members of an LLC to be published. The Company is therefore the sole identified publisher of the site, and bears sole responsibility for the content published and the contracts entered into. This does not remove any identification obligations that may arise from local regulations applicable to the audience addressed — see article 2.

2. Editorial responsibility

Editorial responsibility for the site rests with the Company itself, as the publishing legal entity. Any request concerning the content of the site must be sent to the email address given in article 1; the Company answers in its own name and bears sole responsibility.

Under the law of the State of New Mexico, the identity of the Company’s members and managers is not made public. No natural person is therefore named on this site.

4. Intellectual property

All the elements making up the site — structure, text, visuals, logos, trade marks, graphics, animations, databases, source code, together with the algorithms, indicators, presets, documents and training content published — are protected by intellectual property law and remain the exclusive property of the Publisher or its licensors.

Any reproduction, representation, adaptation, translation, extraction, reuse or distribution, in whole or in part, by any process and on any medium, without the Publisher’s prior written authorisation, is prohibited and constitutes infringement punishable under articles L335-2 et seq. and L342-1 et seq. of the French Intellectual Property Code and under the equivalent provisions of applicable law.

The “Fundy” trade mark and logo are the property of the Publisher. Third-party marks and logos mentioned (MetaTrader 5, MetaQuotes, TradingView, Discord, Stripe, Trustpilot and others) belong to their respective owners and are mentioned for information only. Citing them implies no partnership, sponsorship or endorsement, unless expressly stated otherwise.

5. Independence from third-party platforms

The site and its content are not affiliated with, approved by, sponsored by or administered by the following platforms, which exercise no control over them and assume no responsibility for them:

Where promotional content is published on these platforms, it is published under the sole responsibility of the Publisher. The fact that an advertisement is accepted there does not amount to approval, validation or any guarantee by that platform as to the content, the products or the results presented.

FACEBOOK, INSTAGRAM, GOOGLE, YOUTUBE, TIKTOK, METATRADER, TRADINGVIEW and the other names mentioned are trade marks belonging to their respective owners. They are mentioned for information and technical interoperability purposes only.

6. Product licence

Purchasing a digital product offered on the site grants the buyer a personal, non-exclusive, non-transferable and non-assignable licence, for their own use. The following are prohibited without written authorisation: resale, making available, sharing, rental, public distribution, decompilation, reverse engineering and the creation of derivative works.

7. Personal data

The processing of personal data carried out through the site is described in the privacy policy, which sets out the purposes, legal bases, recipients, retention periods and how to exercise the rights granted by Regulation (EU) 2016/679 (GDPR) and French Act No. 78-17 of 6 January 1978 as amended.

8. Hyperlinks

The site may contain links to third-party sites. The Publisher exercises no control over these sites and accepts no responsibility for their content, practices or privacy policies. Following these links is done entirely at the user’s own risk.

Linking to the site is permitted, provided it does not harm the Publisher’s image, creates no confusion as to the origin of the content, and does not come from a site publishing unlawful content.

9. Risk warning

Trading carries a risk of capital loss. The products offered are software tools. They do not constitute investment advice, a personalised recommendation, a portfolio management service, or any guarantee of results. Past performance, including performance from historical tests (backtests), is not a reliable indicator of future performance. You alone decide on your trades and you alone are responsible for their consequences. Only invest amounts whose loss would not affect your financial situation.

10. Liability

The Publisher endeavours to keep the information published accurate and up to date, but cannot guarantee that it is complete or error-free. The Publisher reserves the right to change the content at any time and without notice.

The Publisher cannot be held liable for damage resulting from unavailability of the site, an interruption of service, the presence of a virus, or the use made of the information and tools provided, to the extent permitted by law.

11. Reporting content

Any content that may be unlawful can be reported to the address given in article 1. The report must state the date, the identity of the notifier, a description and the precise location of the disputed content, and the reasons why it should be removed.

12. Governing law

This legal notice is governed by the law of the State of New Mexico (United States of America), the Company’s state of registration, without prejudice to the mandatory rules set out below.

Contractual relations with buyers are governed by the terms and conditions of sale.

European Union consumers. Under article 6 of Regulation (EC) No. 593/2008 (“Rome I”), the choice of New Mexico law cannot deprive a consumer residing in the European Union of the protection afforded by the mandatory provisions of the law of their country of habitual residence, where the Company directs its activity towards that country — which is the case for a site displaying prices in euros and offering payment in euros. A consumer’s statutory rights (legal guarantees, pre-contractual information, withdrawal) therefore remain intact.
